Family Law Courts

If you are not able to take advantage of any alternative dispute resolution processes, taking into account that they require co operation from both parties, then you may be forced to seek the assistance of the Family Law Courts to resolve your matter.

Married Couples Going Through Separation

For married couples, you must bring proceedings in the Family Law Courts relating to a property settlement or spousal maintenance within 1 year from the date of your divorce.

De Facto Couples Going Through Separation

For de facto couples, you must bring proceedings in the Family Law Courts relating to your property settlement or spousal maintenance within 2 years from the date of separation.

What To Do Next?

If you make an application to the Court outside the time limit, you will be required to seek the Court’s leave (permission) to make your application.

Failure to do so may mean that you are barred from making a claim for property and you may lose your rights to a property settlement being determined by the Court.
