Franshise Agreements
Part of any franchising transaction is the franchise agreement. Under the agreement the franchisor grants the franchisee the right to trade under the business model, including using a licensed trade mark and trade name, and sometimes a marketing plan or operating system used by the franchisor. Franchise agreements are regulated by the Australian Competition and Consumer Commission (‘ACCC’), which enforces the Franchising Code of Conduct.

Disclosure Documents
Maybe the most important document involved in a franchise transaction is the Franchise Disclosure Document (FDD). The Franchise Disclosure Document gives a prospective franchisee key information about the franchise system, and an existing franchisee current information about the running of the franchise. The information includes the company’s legal history, operating cost, company structure (if any master franchise), financial status and agreements, existing franchisees, and more. This information is key in the prospective franchisees’ decision about purchasing the franchised business.
