The Importance of a Legal Will

Wills and Estate Lawyers Gold Coast

It is vital to you and your family to understand the importance of a legal Will.

A Will is a legal document that makes sure your assets will pass to those relatives and friends you intend to benefit. In your Will you can nominate a Trustee to administer affairs or a Guardian to take care of any children. The Guardian can give your personal effects and family heirlooms to loved ones upon your death. You can also nominate your burial or cremation wishes in your Will.

Without a legal Will, your Estate is managed according to the Successions Act. This means your personal wishes may not be met. Legal Wills also assist your family in understanding your wishes, easing the burden during a difficult time. Most Wills are relatively simple to prepare and incur only a small fee. However, more extensive Wills can also be prepared. These include Testamentary Trusts, Estate Planning and Tax minimisation in large estates.

Managing the Estate of a deceased family member can be harrowing. Our Wills and Estate Lawyers on the Gold Coast can assist in careful distribution of assets to beneficiaries. We have extensive experience in managing Estates. This includes obtaining Probate or Letters of Administration, distributing assets and finalising affairs.

Advance Health Directive

An Advance Health Directive allows you to communicate your wishes about what medical treatment you may or may not want in the event you are unable to make the decisions for yourself, i.e whether or not you wish to be resuscitated, have blood transfusions, be put on life support (mechanical ventilation), involuntary feeding and antibiotics. It takes the burden off your family or close friends to make these decisions without knowing your wishes.

Advance Health Directives should be made in addition to your Enduring Power of Attorney as the Advance Health Directive details your specific wishes in relation to health matters. Powers given under a Power of Attorney for health matters are limited and do not allow for decisions to be made to either continue or withhold life-sustaining treatment.
